Bankruptcy, like Debt Relief Order, is a form of insolvency and clears all debts owed by an individual. Imposed by a court order, bankruptcies can only be declared if someone's unsecured debts outweighs their assets.
How does bankruptcy affect someone?
When a bankruptcy order has been made, all assets owned by the individual effectively become the property of the bankruptcy trustee. The trustee will deal with creditor enquiries and notify creditors of the estate. If the debtor is a homeowner, and there is equity in it, the property may be sold. Alternatively if a home is rented, it may be possible to continue living at the same property after bankruptcy as long as there are no rent arrears.
